Intentia comuna a printilor copilului inainte si imediat dupa nastere este mai importanta decat prezenta sa fizica in Romania, tara in care a fost deplasat din Franta pentru a fos prezentat familiei. Curtea de apel Bucuresti invita in mod indirect parintii unui copil nou nascut a avea incredere in justitie si in aplicarea ferma a Conventiei de la Haga din 25 octombrie 1980.
